BIM OBJECT END USER LICENCE AGREEMENT
Background
This website -“bimlibraryeastafrica.com”/ “theBlea.com” (the “Site”) – is operated by BIM Library East Africa. Throughout the Site, the terms “the BLEA”, “we”, “us” and “our” refer to BIM Library East Africa. BIM Library East Africa offers this website, including all information (any specification), tools and services (software, BIM content, BIM objects and CAD details) available from this Site to you, the User, conditioned upon your acceptance of all terms stated here, as well as our Terms and Conditions on the Site.
BIM Library East Africa (the BLEA) is a vendor-neutral platform that showcases construction products from top manufacturers, both local and international, as digital product models. Our library includes BIM objects compatible with popular BIM software such as Revit, ArchiCAD, SketchUp, AutoCAD, and others. These BIM objects are utilised by architects, designers, engineers, and contractors for virtual building and simulating construction projects.
Proprietary Rights
The entire title, ownership rights and all intellectual property rights of content created by the BLEA, including without limitation all information, tools and services, remain with the BLEA. This Agreement is not a sale and nothing contained herein will be deemed to grant the User any right or interest to the intellectual property rights in the website. All materials contained on, or accessible from the Site, including without limitation, information, tools and services, are copyrighted property of the BLEA.
Grant
The User is permitted to download and use material from the Site as long as the use of such content does not compete with the BLEA or misrepresent the BLEA’s connection to the content. The User is granted permission to access the Site and is permitted to use these ‘tools and services’ only for the limited purpose of preparing construction specification, drawing and BIM models and documents as authorized in this Agreement. The User shall not reproduce, adopt, distribute, sell, trade or resell, display or publish these ‘tools and services’ without explicit permission from the BLEA. The User shall not use the Site, its ‘information’, ‘tools and services’ to create or provide content on the User’s behalf or for any third party.
BIM Object Download
Users are required to register for an account on the bimlibraryeastafrica.com (the “Site”) and agree to these terms. As part of the registration for an account, we will collect certain from you (such as your name or contact details) and you agree that any information you provide to the BLEA will always be accurate, correct and up to date. Provision of Service
The BLEA will provide its best effort to ensure the Site is available 24-hours-a-day 365-days-a-year, but we do not guarantee the Site will always be available. The BLEA will not be liable for any loss due to the Site not being available. The BLEA will not be liable for any loss due to errors in our software or the software of others that we use. You are aware, acknowledge and agree that the BLEA may, at its sole discretion, provide any and all Services to you directly or indirectly through an Affiliate.
We are constantly innovating and refining the Service in order to provide the best possible experience for the User. You are aware, acknowledge and agree that the form, nature and content of the Service which we provide may change from time to time without prior notice to you.
Disclaimer of Warranties; Limitation of Liability
All services and content, including BIM objects and specifications, included or otherwise requested by you through the Site are provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
Without prejudice to the foregoing paragraph, the BLEA does not warrant that: – The Site, services and content, including BIM objects and specifications, will be constantly available or available at all; or – The information on this website is complete, true, accurate or error-free.
All specifications and product information represent the applicable information available at the time of its publication. Individual manufacturers reserve the right to change their information from that which is used on the Site at any time without notice to users.
Termination
The BLEA reserves the right to refuse service to anyone at any time for any reason. The BLEA reserves the right to terminate this Agreement at any time. Permission to use the Site, its ‘information’, ‘tools and services’ will terminate immediately if the User breaches any of the terms of this Agreement. Upon termination, the User must discontinue all use of the Site, its ‘information’, ‘tools and services’.
Agreement Effective Date
October 12, 2019.
